U.S. Dept. of Labor NPRM on Employee and Independent Contractor Classification (Oct. 13, 2022)

Notice of Proposed Rulemaking from the U.S. Department of Labor Wage and Hour Division for regulations to revise guidance on classification of independent contractors under the Fair Labor Standards Act (FLSA).  The proposed regulation would rescind the 2021 “Independent Contractor Status Under the Fair Labor Standards Act” Rule and “return to a totality-of-the circumstances analysis in which the economic reality factors are not assigned a predetermined weight and each factor is given full consideration.”  Comments are due on or before November 28, 2022.
